MOEW repealed a resolution of RIEW Stara Zagora for the approval of a photo-voltaic facility in the Sakar Mountains

This repeal came after the complaint lodged by Green Balkans against that resolution.The reason for the repeal of the resolution of RIEW Stara Zagora was the fact that the Report on the Appropriate Assessment of the investment proposal was not in conformity with the requirements of the Decree on Appropriate Assessments and Article 6 (3) of Directive 92/43/EEC.

The main weakness in the resolution of RIEW Stara Zagora based on this report was the lack of a proper and thorough assessment of the cumulative effect of the investment proposal regarding the globally threatened Imperial Eagle (Aquila heliaca), as 50% of the species’ population breeds in the region of Sakar.

By repealing the resolution, MOEW admits the weaknesses in the Act issued by the Director of RIEW Stara Zagora, namely – procedure infringements, non-fulfillment of MOEW prescriptions, lack of qualitative assessment of the cumulative effect that would guarantee proper conclusions on any possible impacts, etc.
We welcome the decision and efforts of MOEW to strengthen the lawfulness of the acts issued by the administration bodies.
